These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and MillionShorts ("Company", "we", "us") regarding your use of the MillionShorts platform available at millionshorts.com (the "Service").

By accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to these Terms and our Privacy Policy.

2. Description of Service

MillionShorts is an AI-powered content automation platform that generates short-form videos (scripts, voiceovers, and video editing) and publishes them to connected social media accounts including YouTube and TikTok, on behalf of the User.

The Service includes:

• AI script generation based on the User's channel niche and configuration
• Text-to-speech voiceover using third-party AI voice providers (ElevenLabs)
• Automated video editing with licensed stock footage (Pexels)
• Automated publishing to YouTube Shorts and TikTok via OAuth
• A web dashboard for configuration and monitoring

3. User Accounts

3.1 Registration

To use the Service you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

3.2 Accuracy

You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

3.3 Account Security

You must notify us immediately at support@millionshorts.com if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized access resulting from your failure to secure your credentials.

4. Subscription and Billing

4.1 Plans

The Service is offered on a subscription basis. Available plans, pricing, and included features are displayed on the pricing page at millionshorts.com/pricing. Prices are in EUR and exclude applicable taxes unless stated otherwise.

4.2 Billing Cycle

Subscriptions are billed monthly or annually (if the annual option is selected) in advance. Billing begins on the date you subscribe and renews automatically on the same day each month or year.

4.3 Free Trial

New users receive one (1) free video generation. No credit card is required for the free trial. After the trial video is generated and published, continued use requires an active paid subscription.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.

4.5 Refunds

We offer a 7-day money-back guarantee on your first paid subscription period. To request a refund, contact support@millionshorts.com within 7 days of your initial charge. Refund requests after this period are evaluated on a case-by-case basis.

4.6 Price Changes

We reserve the right to modify pricing with 30 days' notice via email. Continued use of the Service after the effective date constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use the Service to generate, publish, or distribute content that:

• Violates any applicable law or regulation
• Infringes intellectual property rights of third parties
• Contains defamatory, harassing, or threatening material
• Constitutes spam, misinformation, or coordinated inauthentic behavior
• Promotes hate speech, violence, or discrimination based on protected characteristics
• Contains sexually explicit material or content harmful to minors
• Violates YouTube's Terms of Service, TikTok's Terms of Service, or any other platform's policies

We reserve the right to suspend or terminate accounts that violate these conditions without refund.

6. Content Ownership and Licenses

6.1 Your Content

You retain full ownership of all content published to your connected social media accounts through the Service. MillionShorts claims no ownership over the videos generated on your behalf.

6.2 License to MillionShorts

By using the Service, you grant MillionShorts a limited, non-exclusive license to process your channel configuration data, generate content, and publish to connected accounts solely to provide the Service.

6.3 Third-Party Content

Stock footage used in generated videos is licensed from Pexels under their Content License. AI voiceovers are generated via ElevenLabs under a commercial license included in your subscription. You may use the generated videos commercially on your connected social platforms.

7. Third-Party Integrations

The Service connects to YouTube, TikTok, ElevenLabs, OpenAI, and Pexels via their respective APIs. By connecting your social media accounts, you authorize MillionShorts to act on your behalf within the permissions you grant via OAuth. You remain bound by the terms of service of each respective platform.

MillionShorts is not affiliated with, endorsed by, or officially connected to YouTube, TikTok, ElevenLabs, OpenAI, or Pexels.

8. Service Availability and Limitations

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, third-party API outages, or events beyond our control.

Video generation limits per plan are enforced on a calendar-month basis and reset on the first day of each month. Unused generations do not roll over.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR RESULT ON SOCIAL MEDIA PLATFORMS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MILLIONSHORTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you shall not exceed the amount paid by you in the twelve (12) months immediately preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless MillionShorts and its affiliates, officers, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction in Spain.

13. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and notify you by email if the changes are material. Your continued use of the Service after the effective date of any change constitutes your acceptance of the new Terms.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or non-payment. You may terminate your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.
